Terms of sale

LC2C is a limited liability company with a capital of 10,000 Euros, whose registered office is located at 5 rue de la République 30220 AIGUES MORTES, registered in the Nîmes Trade and Companies Register under number 494 374 218, intra-community VAT number: FR38494374218 (hereinafter referred to as LC2C or the LC2C company).

 

Article 1: Scope of application

These "general terms and conditions of sale" (hereinafter the GTC) apply to distance sales of LC2C products and are reserved for consumers acting exclusively for their personal use (hereinafter the customer), it being specified that French law applies to any order placed on the LC2C website, available at www.indiennesdenimes.fr (hereinafter the site) or by telephone with the sales advisors of the LC2C store, regardless of the country of delivery chosen by the customer.

Any order that does not correspond to a retail sale and, more generally, any fraudulent order may be refused by LC2C. LC2C therefore reserves the right to limit the quantities of an item delivered to the same consumer or to the same postal address.

The purpose of these terms and conditions is to inform any potential customer of the terms and conditions of sale of LC2C items to the customer and to define the rights and obligations of the parties.

For telephone sales, the customer is invited to consult the terms and conditions available on the website before confirming the order.

With respect to sales on the site, the customer, by checking a box provided for this purpose, acknowledges having read the GTC before placing the order and having accepted them without reservation. The GTC may be retained by any person visiting the site and may be printed.

LC2C reserves the right to modify the GTC at any time. Nevertheless, the GTC applicable to the order are those accepted by the customer at the time of placing the order.

The GTC are supplemented by the rules for the use of cookies and the personal data protection policy available on the site.

 

Article 2: Information about the products

Information on LC2C products is available, with their references, on the website. The customer can select one or more items from the various categories offered on the site within the limits of available stocks. LC2C may modify at any time the items offered for sale on the site, without prejudice to orders placed by the customer. For any question or request for advice, the customer may contact LC2C by writing to the following address contact@indiennesdenimes.fr or by calling customer service at +33 9 53 08 30 44.

Despite the care taken in the presentation of the items on the website, LC2C cannot guarantee that their actual appearance corresponds exactly to their appearance on the screen, particularly with regard to color variations. LC2C cannot be held responsible for non-substantive errors that may occur.

LC2C reserves the right to withdraw items from sale at any time. In case of unavailability of any item, the customer will be informed as soon as possible by the customer service. In case of unavailability of one or more items, the customer will be reimbursed by credit card or PayPal account and can proceed with a new order.

 

Article 3 : Orders

Any order implies the acceptance of the GTC and the data processing policy unless specific contractual conditions are concluded between the parties.

3.1 Telephone orders

Orders will be received, in French or English, by LC2C at +33 9 53 08 30 44.

The customer is invited to check the price of the items on the site and to read the GTC also available on the site before validating the order by phone.

The order is payable by credit card. The customer communicates by telephone; the number and the expiry date appearing on the front of his bank card as well as the numbers of the visual cryptogram appearing on the back (or the front) of his bank card. The order is delivered to the home address provided.

3.2 Orders on the site

Orders can be placed on the site. The customer assumes the telecommunication costs for accessing the Internet and using the site. All the steps necessary for the sale are specified on the site. The customer, before definitively validating his order, acknowledges the GTC, checks the details and the total price of his order, corrects possible errors, before confirming his final agreement on the payment of the order.

The customer's attention is drawn to the fact that the validation of an order implies the obligation to pay the agreed price and that once the order is validated, the customer cannot cancel his order, subject to the exercise of his right of withdrawal.

To definitively validate an order, the customer must click on the "Pay" button. Once the customer has validated the order, LC2C acknowledges receipt without delay and electronically. LC2C recommends that customers keep these e-mails on paper or on their computer. In case of non-receipt of these e-mails, the customer is recommended to check if they have not arrived in the spam box. The customer is informed that the e-mails are sent to the e-mail address he/she has entered. Therefore, if there is an error in entering the e-mail address concerned, or if the message confirming the sending or supply of the order is not received, LC2C cannot be held responsible (unless the receipt of the confirmation message is the result of a fault of LC2C). In this case, the sale will be considered final. The customer may nevertheless exercise its right of withdrawal under the conditions set out in article 7 of the GTC.

3.3 Refusal, suspension or cancellation of orders

LC2C reserves the right to refuse or cancel any order for which the number of items or the amount to be paid (for one or more cumulative orders) would not correspond to the average usual use of a household and any order that would imply that an economic activity is being carried out by the customer in relation to the items ordered or more generally, any abnormal order. Finally, LC2C reserves the right to suspend or cancel any execution of an order and/or delivery, in the event of non-payment or partial payment of the price, in the event of a payment incident, or in the event of fraud or attempted fraud concerning the use of the site, including on the occasion of previous orders.

 

Article 4 : Price of the articles

The price of the articles is indicated in euros including all taxes (TTC).

The price of the articles does not include the shipping costs of the products of the order which will be indicated to the customer at the latest at the time of the payment of the order. Shipping costs vary depending on the delivery address.

Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These possible customs duties and taxes related to the delivery of an item are the responsibility of the customer. LC2C is not required to verify and inform the customer of applicable customs duties and taxes.

The selling prices of the items online on the website are those in effect at the time the customer places the order. The selling prices of the items may be changed by LC2C at any time. LC2C regularly checks that the prices charged are correct. However, some prices may be affected by an error. If LC2C notices a pricing error in the order, the customer will be notified as soon as possible. LC2C reserves the right to cancel the order for the item affected by an obvious pricing error. If the order has been paid, the customer will be immediately refunded the amount paid.

 

Article 5: Terms of payment

The payment of orders on the site can be made :

- by check: the customer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or informs a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by check". Finally, the last step proposes to him to check all the information, to acknowledge and to accept the GTC by ticking the corresponding box, then invites him to validate his order by clicking on the button " Confirm my order ". This last click constitutes the final conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of his order. In order to finalize payment and process the order, the customer must print this order form, along with a check made out to "LC2C - Le Comptoir de Camargue" to the following address LC2C - Le Comptoir de Camargue, 5 rue de la République 30220 AIGUES MORTES. No cash payment should be sent. Only checks issued by a French bank will be accepted. Upon receipt of the check, the order will be processed and the customer will be informed by email. LC2C will ship the products at the earliest 2 business days after receipt of the check corresponding to the order, subject to provisions.

-Through the customer's PayPal account. By choosing payment via PayPal, the customer will be automatically directed to his PayPal account. Once the PayPal payment is validated, the customer will see the order confirmation page on the site.

-By Apple Pay. The buyer is redirected to the secure Apple Pay interface in order to enter his Apple Pay account details or to use bank cards already in use.

- by credit card (cards from the "CB" network, Visa, Eurocard/Mastercard, American Express are accepted). In this case, the customer's credit card is charged when the order is placed.

If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card, Paypal account or Apple Pay is irrevocable.

The customer guarantees to LC2C that he is the holder of the credit card and that the name appearing on the credit card to be debited is his own, and then communicates in a secure environment on the Internet; the number and expiration date appearing on the front of his credit card as well as the numbers of the visual cryptogram appearing on the back (or the front) of his credit card.

When ordering by phone, the customer confirms that he is the holder of the credit card and that the name on the credit card to be charged is his. He then communicates, by telephone, the number and expiration date appearing on the front of his credit card as well as the visual cryptogram numbers appearing on the back (or front) of his credit card.

In the event that the debit of the sums due by the customer would be impossible for any reason whatsoever, the sale made by telephone would be immediately resolved and the purchase process on the Internet would be immediately cancelled.

 

Article 6 : Delivery and reception

All the information concerning the delivery conditions are available on the page of validation of the basket and before the payment of the order.

6.1 Delivery times

The delivery times are indicated to the customer at the time of placing the order. The delivery of the ordered items will take place within the deadlines communicated by LC2C, and within a maximum of 30 days from the date of the order (subject to full payment of the price).

Delivery times begin to run upon receipt of the order confirmation by email. The delivery times take into account the time of the order and the working days of the country of destination.

Delivery times may, during the holiday season or sales, be extended due to the high activity of the company LC2C at this time of year. Nevertheless, these delays may not exceed 30 days after the conclusion of the order.

6.2 Delivery address

Items ordered by the customer in accordance with the GTC are delivered to the address indicated by the customer as the delivery address on the order concerned.

If delivery is not possible due to the absence of the recipient at the place of delivery, a notice will be left at the delivery address indicated by the customer and the carrier will make a new delivery attempt on the next working day.

6.3 Delivery to the store in Aigues Mortes

Delivery is free at the store located 5 rue de la République 30220 AIGUES MORTES.

As soon as your package is available in the store, you will receive an e-mail or a call from the store.

Upon receipt of the package in the store, you have 15 calendar days to come and pick up your package, with the order confirmation email and an ID.

Another person can pick up the package for you, provided that this person has the order confirmation email. This person will have to present a copy of your ID and sign for you at the time of collection.

6.5 Damaged packaging or product, missing product

The customer, or the recipient of the order is invited to check the apparent state of the package and the articles on delivery.

WARNING: in case of damaged package or product, or missing product the customer must imperatively follow the procedures described below. Failure to follow the appropriate procedure will exclude any recourse against the carrier and the company LC2C. The customer must contact customer service within 7 days of receipt at contact@indiennesdenimes.fr with a photo of the item concerned and follow the same return procedure as described and detailed in Article 7.

 

Article 7 - Right of withdrawal

In accordance with article L. 221-18 of the French Consumer Code, the customer has the right to withdraw from a sale made remotely on the website or by telephone. The customer can exercise this right, without having to justify it, within 14 days from the receipt of the product by the customer. Any request for return made after this period may be rejected.

In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for orders relating to

- the supply of goods manufactured to the customer's specifications or clearly personalized;

- the supply of goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.

In order for the return and refund to be validated and processed quickly, the customer must follow the procedures described below. Failure to do so may result in a refusal of the return and a return of the product to the customer, without refund.

 

Making a request for return or exchange

The customer has a period of fourteen (14) days, from the date of receipt of his order, to return the items, without justification or penalty. For any return under the right of withdrawal, the procedure below must be fully respected:

The customer must attach to his package the return form previously completed and printed using the return form accessible from the customer area - Section "My Orders". No return will be accepted without the aforementioned return form duly completed.

If the customer wishes an exchange, it will be necessary to indicate what it wishes in exchange.

All items returned by the customer must not have been worn, damaged, soiled or washed by the customer. They must be returned in their original packaging, with their label and any accessories, to the return address mentioned above.

Only the cost of return from Metropolitan France will be charged to LC2C (except sales or promotions). A prepaid return label provided in the package must be used by the customer. The cost of returning the goods from another country than Metropolitan France is the responsibility of the customer. Subject to the above conditions, the refund of products related to the right of withdrawal will be made within fourteen (14) working days from the date of receipt of the items by LC2C. LC2C will proceed with the refund using the same payment method used by the customer to pay for the order.

In the event of loss or damage in transit, the customer should contact the carrier directly. If the items are not received at the address indicated above, LC2C will not be able to process the return.

Return the item(s)

- Place the item(s) in the box or envelope in its original carton or other solid cardboard box.

- Tape the box closed.

- Use the return label provided by Customer Service and place it on the shipping carton.

- Make sure your package has no other shipping or tracking labels.

- Drop off your box in your mailbox (www.colissimo.fr/retourbal), at a post office or at a La Poste partner location (www.colissimo.fr/retour).

- Items should be returned to the address on the return label provided.

Refund

The refund will be credited to the credit card of the buyer, to the PayPal account of the customer, or by check made out to the customer.

The refund will be made within 14 days of receipt of the returned item.

No refund will be made if the item is not returned in perfect condition.

Important information

Items must be returned in perfect condition, exactly as delivered, with the tag and seal still attached. All shoes must be tried on a carpeted surface until the customer decides to keep them.

 

Article 8 - Legal warranties

All LC2C products are covered by a warranty of conformity and a warranty against hidden defects.

8.1 Guarantee of conformity

Article L217-4 of the French Consumer Code states that: "The seller delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility. "

In accordance with Article L217-5 of the Consumer Code, "The goods conform to the contract:

1° If it is fit for the purpose usually expected of a similar good and, where appropriate :

- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model ;

- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter.

The action resulting from the lack of conformity is prescribed within two years from the delivery of the goods, as provided for in Article L211-7 of the Consumer Code.

The customer may choose between repair or replacement of the item, subject to the cost conditions envisaged by Article L. 217-9 of the Consumer Code;

It is possible that the stocks do not allow the replacement of the identical article. It will be consequently and in any case, proceeded to the refunding of the article not in conformity and its replacement by an article of equivalent price, if the customer wishes it by placing a new order.

8.2 Guarantee against hidden defects

Article 1641 of the Civil Code states that: "The seller is bound by the warranty for latent defects of the thing sold which render it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lesser price, if he had known about them. "

Article 1648 of the Civil Code stipulates that: "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect".

Under the legal guarantee of latent defects, LC2C, in accordance with Article 1644 of the Civil Code, and according to the customer's choice, undertakes after evaluation of the latent defect :

- Either to refund the full price of the item returned,

- Or to refund a part of the price of the article, if the customer decides to keep the article.

8.3 Exclusion of guarantees

The articles modified or repaired by the customer are excluded from the guarantee. In the same way, the guarantee will not apply to apparent defects in application of article 1642 of the Civil Code. Finally, the guarantee will not cover items damaged during transport or due to misuse.

 

Article 9: Complaints-information

For any information, complaint or question concerning the GTC or the products, customers should contact the customer service of the company LC2C by phone: +33 9 53 08 30 44, or by email at contact@indiennesdenimes.fr recalling their order number, if any.

 

Article 10 - Personal data and rules for the use of cookies

LC2C undertakes to protect and guarantee the security and confidentiality of its customers' personal data in accordance with the RGPD, in particular by taking all necessary precautions to prevent such data from being distorted, damaged or accessed by unauthorized third parties.

The customer is invited to read and download LC2C's data protection policy and rules for the use of cookies available on the website.

 

Article 11- Retention of title

LC2C retains full ownership of the items sold until full payment of the price including all taxes and any delivery costs and additional charges generated at the express request of the customer.

 

Article 12 - Intellectual property rights

The trademarks "Les Indiennes de Nîmes", "Mistral", "Lou Felibre", "Le Comptoir de Camargue", as well as all figurative or non-figurative trademarks and more generally all other trademarks, illustrations, images and logos appearing on the articles, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of LC2C.

Any reproduction, modification or use, in whole or in part, of these trademarks, illustrations, images, logos, or any combination or conjunction with any other trademark, symbol, logo and more generally any distinctive sign intended to form a composite logo, on any or all of the products, without the express prior consent of LC2C, is strictly prohibited.

The same applies to all copyrights, designs and patents owned by LC2C.

The use of all or part of the website, including downloading, reproduction, transmission or representation for purposes other than personal and private non-commercial use is strictly prohibited.

Any violation of these provisions exposes its author to the sanctions provided for by the civil code and the intellectual property code.

In addition, the creation of a hypertext link to the LC2C website can only be done with the prior and express agreement of the LC2C company.

This agreement may be revoked at any time if the conditions of the authorization are not met.

LC2C declines all responsibility for the terms of use and content of any third-party sites from which hypertext links allow access to the site.

 

Article 13 - Signature and proof

LC2C strives to protect the personal information of its customers by ensuring a high level of security.

The customer also has a role to play in protecting his personal data. In particular, the customer must maintain the security of its online transactions by not disclosing its username (e-mail address) and/or password to anyone and by changing its password regularly.

Therefore, the LC2C company cannot be held responsible for the disclosure of information about the customer to any person who has used the customer's username (e-mail address) and/or password.

LC2C declines all responsibility for any fraudulent use of this information.

The provision of the credit card number or the payment of the amounts due and the final validation of the order will be proof of acceptance of the said order. The computerized records kept in the computer systems of LC2C and its partners will be considered as proof of communications, orders and payments between the parties.

 

Article 14 - Force majeure

Pursuant to Article 1218 of the Civil Code, LC2C will suspend any performance of its contractual obligations in the event of force majeure.

LC2C will inform the customer within seven (7) days of its occurrence. If this suspension continues beyond a period of fifteen (15) days, the customer would then have the option of cancelling the order in progress, and would then be refunded.

 

Article 15 - Litigation - Applicable law

The sale of products sold on the site is subject to French law.

The GTC, as well as the contractual relationship between the customer and LC2C are governed by French law.

In the event of a dispute, the customer shall first contact LC2C to obtain an amicable solution. If no agreement is reached, the competent Courts of law shall have exclusive jurisdiction.
